These Terms of Service ("Terms") govern your access to and use of the Elia Fuel LLC website located at eliafuel.com (the "Site") and any purchases made through the Site. By accessing the Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, do not use the Site.

2. Eligibility
You must be at least 18 years of age to purchase from this Site. By placing an order, you represent that you are 18 or older and legally capable of entering into a binding contract.
3. Products & Descriptions
We make reasonable efforts to display product descriptions, ingredients, and images accurately. However, we do not warrant that product descriptions or other content on the Site are complete, accurate, or error-free. Product formulations may be updated; always refer to the current product label for the most accurate information.
4. Orders & Payment
All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion. Prices are listed in U.S. dollars and are subject to change without notice. Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout.
5. Pricing & Sales Tax
Applicable sales tax will be collected for orders shipped to New Jersey and any other states where we are required by law to collect sales tax. Tax amounts are calculated at checkout based on your shipping address.
6. Shipping
We ship to addresses within the United States. Estimated delivery times are provided at checkout and are estimates only; we are not responsible for carrier delays. Risk of loss and title for products pass to you upon delivery to the carrier. See our Shipping Policy for full details.
7. Subscriptions
If you subscribe to receive recurring product shipments, you authorize us to charge your payment method on the agreed billing schedule. You may cancel your subscription at any time by logging into your account or contacting us at alex@eliafuel.com before your next billing date.
8. Intellectual Property
All content on the Site, including text, images, graphics, logos, and trademarks, is the property of Elia Fuel LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
9. User Conduct
You agree not to use the Site to: (a) violate any applicable law; (b) transmit harmful, offensive, or fraudulent content; (c) interfere with or disrupt the Site or servers; or (d) collect user data without authorization.
10. Disclaimer of Warranties
THE SITE AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIA FUEL LLC AND ITS MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PRODUCT.
12. Indemnification
You agree to indemnify and hold harmless Elia Fuel LLC and its members, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Morris County, New Jersey. You consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
